Fifteen years after 78 punk rockers, homeless street youth and supporters were arrested and fined for staying out after midnight in a downtown square, a class-action lawsuit against the city of Montreal and the Montreal police force for several thousand dollars per punker is finally being heard in Quebec Superior Court.

Social activist David Kavanaght, who is not now and has never been a punker, is heading the lawsuit because he said the arrests and tickets were illegal and the rights of dozens of people, many of whom were too marginalized to stand up for themselves, were trampled.

"It is not because people have green hair or different clothes that they don't have rights," Kavanaght said when he launched the suit 12 years ago. Kavanaght, now 42 and a civil servant employed by the Quebec government, participated in the midnight protest as a supporter.

The arrests amounted to "social profiling," he said Tuesday, as they targeted people who were poor or have meagre resources and using tickets or police force in an effort to cleanse the downtown core, when other solutions such as social housing should have been used.

The police? You said it yourself - they broke the curfew. Read your own post, bud. It's only one line long. Not too much of a strain I hope.

Okay I read the whole article, it's kind of a grey area, so I guess what ever happens, happens.
